Default rule and exceptions
Hialeah Code § 82-91 makes it unlawful for the abutting owner to let the sidewalk stay unsafe and requires the owner to inspect and notify the City. But if the City investigates and determines the condition was not caused by the owner, occupant, agent or a third party, the City repairs it at no charge. If the owner caused the damage, the owner pays. So an ordinary (not owner-caused) defect is repaired by the City.

Upon investigation and determination by the city that the condition was not caused by action of the owner, occupant or agent thereof, or third party, the city will not charge the owner, occupant, agent or third party if the city repairs the condition.
