Default rule and exceptions
NYC Administrative Code § 7-210 puts sidewalk maintenance and liability on the abutting owner, EXCEPT for owner-occupied one-, two- or three-family residential property (Tax Class 1). For those homes, the NYC Parks Trees & Sidewalks Program repairs severe damage caused by City street-tree roots at City expense.

It shall be the duty of the owner of real property abutting any sidewalk... to maintain such sidewalk in a reasonably safe condition.... This subdivision shall not apply to one-, two- or three-family residential real property that is (i) in whole or in part, owner occupied, and (ii) used exclusively for residential purposes.
