The property owner (or HOA/responsible management entity) is responsible for septic system repairs and replacement, per EPA, the duty to fix a failed system applies even if a planned sale falls through.

**Boundary:** EPA states the property owner (or HOA/other responsible management entity) is responsible for overall O&M including repairs or replacement; a failed inspection or malfunction triggers the owner's duty to fix regardless of sale plans.

**Exceptions:** If a system fails inspection and the owner cancels a sale, the owner is still obligated to repair it (MA DEP).
