# Washington Condo Water Damage: Who Pays | Who Pays the Repair?

> Washington condo associations must insure at 80% of actual cash value; the insurer can't pursue owners, their households or tenants (RCW 64.34.352).

**Who pays:** shared

Washington requires the association to carry property insurance on the condominium for at least 80 percent of actual cash value. Each owner is an insured person for liability tied to the common elements, and the insurer waives subrogation against owners, their households and tenants (RCW 64.34.352). Newer condominiums under chapter 64.90 keep the same 80 percent floor (RCW 64.90.470).

**Boundary:** The association must maintain property insurance on the condominium, to the extent reasonably available, for not less than eighty percent of the actual cash value of the insured property after deductibles, or a higher amount the declaration sets (RCW 64.34.352). Each unit owner is an insured person under the policy for liability arising from the owner's interest in the common elements or membership in the association, and the insurer waives subrogation against any unit owner, member of the owner's household and lessee. Condominiums governed by chapter 64.90 follow RCW 64.90.470, which keeps the eighty percent floor.

**Exceptions:** Insured-person status covers liability arising from the owner's interest in the common elements or membership in the association; Condominiums governed by chapter 64.90 follow RCW 64.90.470, with the same eighty percent floor
