# Texas: Landlord Won't Repair? Your Options | Who Pays the Repair?

> Texas tenants can repair-and-deduct up to one month's rent or $500 if the landlord won't fix a health/safety issue, under Property Code § 92.0561.

In Texas, if the landlord fails to repair a health/safety condition within a reasonable time, the tenant may have it fixed and deduct the cost from rent, capped at one month's rent or $500 under Property Code § 92.0561.

**Boundary:** Once a Texas landlord is liable under Property Code § 92.056 for a health/safety condition and fails to repair within a reasonable time (7 days presumed reasonable), the tenant may have the repair made and deduct the cost from rent under § 92.0561, capped at one month's rent or $500, whichever is greater.

**Exceptions:** The repair-and-deduct cost cap is one month's rent under the lease or $500, whichever is greater.
