# Texas Condo: Who Pays for Common Element Repairs? | Who Pays the Repair?

> Under the Texas Uniform Condominium Act the association maintains the common elements but the owner pays for unit-serving utilities, windows and doors, under Tex. Prop. Code 82.107.

**Who pays:** shared

Under the Texas Uniform Condominium Act, the association maintains the common elements and each owner their unit, but the owner also pays for utilities, windows and doors serving only their unit, even outside the unit boundary, unless the declaration says otherwise.

**Boundary:** Tex. Prop. Code 82.107 (condos created on/after Jan 1, 1994): except as the declaration or subsections (b)/(c) provide, the association maintains the common elements and each owner the unit. (b) the owner pays for utility installations/equipment serving only their unit even if outside the boundary; (c) the owner pays for windows and doors serving only their unit.

**Property owner:** Maintain, repair and replace the unit; plus unit-serving utility equipment (electricity, water, sewage, gas, water heater, HVAC, antenna) even outside the unit boundary, and windows and doors serving only the unit.

**City / agency:** The association maintains, repairs and replaces the common elements. It may enter a unit after notice to prevent water waste or repairs that would otherwise cause water damage.

**Exceptions:** The declaration may reallocate; Subsections (b) and (c) put unit-serving utilities/windows/doors on the owner; Pre-1994 condos fall under Ch. 81
