# Texas Condo Water Damage: Who Pays | Who Pays the Repair?

> Texas condo associations collect assessments for common expenses and insure the common elements for at least 80% of replacement cost or cash value.

**Who pays:** shared

Texas's Uniform Condominium Act puts common-element insurance and repair funding with the unit owners' association: the board collects assessments for common expenses, and the association must insure the insurable common elements for at least 80 percent of their replacement cost or actual cash value (Tex. Prop. Code 82.102, 82.111).

**Boundary:** Unless the declaration provides otherwise, the association, acting through its board, adopts budgets and collects assessments for common expenses from unit owners (Tex. Prop. Code 82.102). The association must maintain, to the extent reasonably available, property insurance on the insurable common elements, including fire and extended coverage, for at least 80 percent of the replacement cost or actual cash value of the insured property (82.111).

**Exceptions:** The declaration may otherwise provide for association powers and insurance requirements
