# Sidewalk Repair in Seattle, WA: Who Pays? | Who Pays the Repair?

> In Seattle the owner repairs the sidewalk, unless a City-owned tree or City sewer line caused the damage; then SDOT repairs it.

**Who pays:** owner

Seattle: the abutting owner is responsible for sidewalk repair, unless a City-owned tree or a City sewer line caused the damage; then the City repairs it.

**Boundary:** Seattle Municipal Code § 15.72.010 authorizes SDOT to serve the abutting owner notice to repair or renew an unsafe sidewalk; on the owner’s failure the City performs the work and assesses the cost to the owner (§ 15.72.020). Snow and ice removal is an owner/occupant duty (§ 15.48.010).

**Property owner:** Repair or renew the abutting sidewalk on notice from the Director of Transportation (§ 15.72.010); if the owner fails, SDOT does the work and assesses the cost (§ 15.72.020). Remove snow and ice from abutting sidewalks in a timely manner (§ 15.48.010).

**City / agency:** On owner default, SDOT performs the repair and assesses the cost against the property; owners may also contract with SDOT to do the restoration (§§ 15.72.010(B), 15.26.020).

**Exceptions:** If City infrastructure such as a City-owned tree or sewer line caused the damage, the City takes responsibility for the repair.; SDOT says it has a significant backlog and cannot repair many locations that qualify.
