# Florida Renters: Who Pays for Repairs? (Landlord vs Tenant) | Who Pays the Repair?

> Florida Statutes Section 83.51 requires landlords to maintain structural components and plumbing. See the tenant's remedy if they don't.

**Who pays:** landlord

In Florida, the landlord must comply with housing codes or keep structural components and plumbing in good repair under Florida Statutes Section 83.51(1), unless the tenant, family, or a guest caused the damage; if not fixed within 7 days of written notice, the tenant can terminate the lease under Section 83.56(1).

**Boundary:** Florida landlords must comply with applicable building/housing codes, or where none apply, keep the roof, walls, floors, steps, and plumbing in good repair, under Florida Statutes Section 83.51(1).

**Exceptions:** Landlord is not responsible for conditions created or caused by the negligent or wrongful act or omission of the tenant, a member of the tenant's family, or another person on the premises with the tenant's consent (Section 83.51(4)).
