# Florida Condo Common Elements: Who Pays to Maintain Them? | Who Pays the Repair?

**Who pays:** shared

In a Florida condo, the association maintains the common elements, the building structure and exterior envelope, as the default under §718.113, unless the declaration assigns a limited common element to you.

**Boundary:** Fla. Stat. § 718.113(1): maintenance of the common elements is the association's responsibility, except any limited-common-element maintenance the declaration assigns to the unit owner. Which parts of the building count as common elements is set by the condominium declaration.

**Property owner:** Maintain the unit and any limited common element the declaration assigns to the owner.

**City / agency:** The association maintains the common elements as a common expense. Per Fla. Stat. § 718.113(1): "Maintenance of the common elements is the responsibility of the association, except for any maintenance responsibility for limited common elements assigned to the unit owner by the declaration."

**Exceptions:** The declaration may assign a limited common element (balcony, assigned terrace) to the owner, at the owner's cost or shared; Casualty repair follows the insurance/reconstruction rules (see the water-leak record)
