# Colorado Condo: Who Pays for Common Element Repairs? | Who Pays the Repair?

> Under Colorado's CCIOA the association maintains the common elements and each owner the unit, under C.R.S. 38-33.3-307.

**Who pays:** shared

Under Colorado's CCIOA, the association is responsible for maintaining, repairing and replacing the common elements and each owner for their own unit, under C.R.S. 38-33.3-307, unless the declaration says otherwise.

**Boundary:** C.R.S. 38-33.3-307 (CCIOA): except as the declaration, subsection (2), or 38-33.3-313(9) provide, the association maintains/repairs/replaces the common elements and each owner the unit. Limited common elements are not split in 307, they follow the declaration / CCIOA common-expense allocation (38-33.3-315).

**Property owner:** Maintain, repair and replace the unit; give the association reasonable access through the unit (the party causing damage, or expense to avoid damage, pays for prompt repair).

**City / agency:** The association maintains, repairs and replaces the common elements.

**Exceptions:** The declaration may reallocate; Casualty/insurance under 38-33.3-313(9); Limited common elements follow the declaration / 38-33.3-315
