# Who Pays for Mudslide Damage in California? | Who Pays the Repair?

> California Department of Insurance says homeowner policies generally exclude mudflow, mudslide and debris flow damage, and the NFIP excludes landslides.

Standard California homeowner policies generally exclude mudslide and debris flow damage and the NFIP does not cover landslide damage; a wildfire cause may change that.

**Boundary:** The California Department of Insurance says homeowner policies generally exclude damage from mudflow, mudslide, debris flow and landslide, and that landslide damage is not covered under the National Flood Insurance Program. If others' actions or negligence caused the event, the department points to an attorney. LA County Public Works says maintenance of its hillside slope and bench drains is, with few exceptions, the homeowner's responsibility.

**Exceptions:** Under "efficient proximate cause", if a wildfire (a covered peril) was the efficient proximate cause of the mudflow, mudslide, debris flow or landslide, there may be coverage under the homeowner policy.
